1. Business arguments do not apply to EU corrections. Provide the reasoning taking into account the rules and procedural boundaries of whoever is assessing the correction.
2. Do not recycle contracts. The argument "nobody has challenged it yet" does not prove that the contract is of good quality. You live with the procurement for a few months, you will live with the contract for a few years. Have you thought about the timeline for performance, contract modification, grounds for termination, or contract penalties? A good contract reduces the risk that you will procure a speculator.
3. The content of the contract is negotiable. Public procurement is a negotiation process with specific rules. Use legal tools to achieve a balanced contract.
